Non-EU businesses operating within the EU are facing increasingly stringent regulations that could significantly impact their operations. The European Commission’s recent exclusion of non-EU bidders from public tenders under the Foreign Subsidies Regulation (FSR) for incomplete notification underscores its tough approach to enforcement of the FSR. Separately, the Court of Justice of the European Union has aligned the calculation of the upper limits for fines under the General Data Protection Regulation (GDPR) with EU competition law. The Court of Justice of the European Union ruled that fines under the GDPR should be calculated based on global turnover rather than solely on the revenue of entities involved in the breach. Meanwhile, the European Commission is reviewing its antitrust rules in the automotive sector, including the Motor Vehicle Block Exemption Regulation (MVBER). These regulatory developments highlight the importance for non-EU businesses to stay informed and be prepared to adapt to the evolving EU legal landscape.
