・"Case summary of the Tokyo District Court decision that granted provisional injunction against the issuance of investment equity by an investment corporation on the grounds that: (i) the issuance violated Article 82, paragraph 6 of the Act on Investment Trusts and Investment Corporations (the "Act"), and (ii) the corporate officer failed to perform his duty of due care as a prudent manager as well as his fiduciary duty with respect to the investment corporation, since the subscription amount was not "fair" in light of the same provision of the Act.
